AN ACT
RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE KNOWN AS ACCOUNT WAGERING; PROVIDING PENALTIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 30, Article 19 NMSA 1978 is enacted to read:
"[NEW MATERIAL] ACCOUNT WAGERING.--
A. Account wagering consists of receiving, transmitting or forwarding any information or anything of value to place a bet or to assist in the placement of a bet through the use of an account wagering system, whether the account wagering system is located within or outside New Mexico.
B. Whoever commits account wagering is guilty of a fourth degree felony.
C. For purposes of this section, "account wagering system" means a system of betting in which a person deposits money in an account and then uses the account balance to pay for bets placed in person, by telephone or by other electronic means, including by internet, wire or cable."
Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
