AN ACT
RELATING TO PUBLIC SCHOOLS; ALLOWING CHARTER SCHOOL STUDENTS TO PARTICIPATE IN SCHOOL DISTRICT EXTRACURRICULAR ACTIVITIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the 1999 Charter Schools Act is enacted to read:
"[NEW MATERIAL] CHARTER SCHOOL STUDENT PARTICIPATION IN PUBLIC SCHOOL EXTRACURRICULAR ACTIVITIES.--
A. The local school board in the school district in which a charter school is located shall allow charter school students to participate in school district extracurricular activities if they meet eligibility requirements other than enrollment in a particular public school.
B. The New Mexico activities association shall allow charter school students in grades seven through twelve to participate in extracurricular activities, including intramural and intermural sports sponsored by the association, if they meet eligibility requirements other than enrollment in a particular public school.
C. A charter school student shall be eligible to participate in an extracurricular activity in the public school in the attendance zone in which the student lives or goes to school; provided, however, the student may choose only one public school in which to participate in extracurricular activities."
