AN ACT

MAKING AN APPROPRIATION TO ESTABLISH A NATIONAL DEFENSE CADET CORPS AT CAPITAL HIGH SCHOOL IN SANTA FE; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Two hundred eleven thousand seven hundred dollars ($211,700) is appropriated from the general fund to the public education department for expenditure in fiscal years 2005 and 2006 to establish a national defense cadet corps at Capital high school in Santa Fe. This appropriation is contingent upon receipt by Capital high school of an evaluation graded "successful" by the national defense cadet corps on the school's complete capability and readiness to initiate such a program. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall revert to the general fund.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
