Mr. Speaker:
Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred
HOUSE BILL 602, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike House Taxation and Revenue Committee Amendments 2 and 3.
2. On page 12, between lines 1 and 2, insert the following new section:
"Section 9. [NEW MATERIAL] ELECTION REQUIRED FOR CREATING OR CONTINUING DISTRICT.--
A. No ordinance creating a district shall become effective until approved in an election by a majority of the voters in the district voting on the question. An election on the approval of the ordinance creating the district shall be held in conjunction with the next regular municipal election or, if sooner, in conjunction with a special municipal election called for another purpose.
B. If approved in the election, unless terminated pursuant to Section 14 of the Neighborhood Improvement District Act, an ordinance creating a district shall remain in effect for six years and may be extended for successive six-year terms if, prior to each expiration date, the ordinance is again approved by a majority of the voters in the district voting on the question in an election held in conjunction with a regular municipal election or in conjunction with a special municipal election called for another purpose.".
3. Renumber the succeeding sections accordingly.
4. On page 15, line 24, strike "every five years" and insert in lieu thereof "five years after an election approving or continuing an ordinance creating the district".
5. On page 16, line 7, after the period insert "If the council determines that the district should not terminate, an election shall be held pursuant to Subsection B of Section 9 of the Neighborhood Improvement District Act.".
