AN ACT

RELATING TO ELECTIONS; REQUIRING THE SECRETARY OF STATE TO PAY THE COSTS OF CERTAIN SPECIAL ELECTIONS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. SPECIAL ELECTIONS--COSTS.--The secretary of state shall pay the costs of conducting statewide special elections and elections called for the purpose of filling a vacancy in the office of United States representative and shall reimburse the counties for expenses incurred in conducting those elections; provided, however, that the secretary of state shall pay only those costs in an amount equal to or less than the amount appropriated for that election.

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
