    Your JUDICIARY COMMITTEE, to whom has been referred

 

HOUSE BILL 507, as amended

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. Strike House Labor and Human Resources Committee Amendment 11.

 

     2. On page 1, line 13, strike "EXPANDING JURISDICTION;".

 

     3. On page 9, line 4, after "($5,000)" strike the remainder of the line, strike line 5 in its entirety and strike line 6 up to the period.

 

     4. On page 9, line 9, before "within" strike "citation" and insert in lieu thereof "violation of Chapter 50, Article 6 NMSA 1978 by the employer" and after "period" strike "of the employer".

 

     5. On page 9, strike lines 10 through 17 in their entirety and insert in lieu thereof ", the director of the labor and industrial division of the labor department shall forward the matter to the local district attorney who shall prosecute the matter. Upon conviction, the employer may be sentenced to county jail for a period of not less than thirty days and for any succeeding conviction for the like offense, the employer shall be guilty of a fourth degree felony.".

 

     6. On page 9, strike line 25 and on page 10, strike lines 1 through 7.

 

     7. Renumber the succeeding sections accordingly.

 

     8. On page 10, line 17, strike “The director of the” and strike lines 18, 19, and 20 in their entirety.

 

     9. On page 10, line 21, strike “incur such other expenses as may be necessary.”.,
