AN ACT

RELATING TO ELECTIONS; ESTABLISHING REPORTING REQUIREMENTS OF ELECTION RESULTS AND INFORMATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 1-6-10.2 NMSA 1978 (being Laws 2003, Chapter 378, Section 1) is amended to read:

     "1-6-10.2. [ABSENTEE] VOTER RETURNS--REPORTING.--

          A. The county clerk shall report to the secretary of state the total votes in each precinct for each candidate and ballot question as follows:

                [A.] (1) vote totals by voters who vote in person on election day;

                [B.] (2) vote totals by absentee voters who vote early in person; and

                [C.] (3) vote totals by absentee voters who vote by absentee ballots by mail.

          B. The county clerk shall report to the secretary of state the number of voters who signed the signature roster in each precinct and the number of provisional ballots cast in each precinct and the total number of each type of paper ballot printed, cast, spoiled or destroyed by the county for the election.

          C. The secretary of state shall post the information reported pursuant to this section on the secretary of state's web site."
