A JOINT MEMORIAL
REQUESTING NOTIFICATION OF THE ACEQUIA COMMISSION WHENEVER ACTION IS BEING CONSIDERED THAT AFFECTS ACEQUIAS OR COMMUNITY DITCHES.
WHEREAS, Section 73-2-65 NMSA 1978 creates the acequia commission; and
WHEREAS, Section 73-2-66 NMSA 1978 requires the acequia commission to "provide advice and assist the governor, legislature, office of the state engineer and interstate stream commission . . . in . . . acequia and community ditch matters; serve as a facilitator for communication between acequia and community ditch associations and state and federal agencies; and review and comment on any plan or legislation affecting acequias or community ditches to the governor, the legislature, the secretary of agriculture and the interstate stream commission"; and
WHEREAS, the governor, the legislature and various state and federal agencies dealing with New Mexico water are obligated to cooperate with the acequia commission in the discharge of these duties;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the governor, the state engineer, the interstate stream commission, the secretary of environment, the secretary of energy, minerals and natural resources and other agencies dealing with water are requested to actively apprise the acequia commission of any activity affecting the interests of acequias or community ditches in New Mexico; and
BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the governor, the state engineer, the director of the interstate stream commission, the secretary of environment and the secretary of energy, minerals and natural resources.
