Fiscal impact reports (FIRs) are prepared by the Legislative Finance Committee (LFC) for standing finance committees of the NM Legislature. The LFC does not assume responsibility for the accuracy of these reports if they are used for other purposes.

Synopsis of SFC Amendment

 

The Senate Finance Committee amendment deletes the specific request to expand the Guadalupe County Correctional Facility by 52 cells to accommodate an additional 104 inmates.

 

Synopsis of Original Bill

 

Senate Joint Memorial 33 requests the CD to examine the need for feasibility and other issues regarding the possible expansion of the Guadalupe County Correctional Facility by 52 cells to accommodate an additional 104 inmates.

 

 Significant Issues

 

CD provided the following:

 

Governor Richardson has repeatedly stated that he is opposed to building additional prison bed space.  Since the Guadalupe County Correctional Facility is privately operated and the Corrections Department pays a per diem rate to house its inmates there, it is unclear whether building additional prison bed space there would be contrary to Governor Richardson’s position.

The Guadalupe County Correctional Facility has at times had difficulty filling all of their staff positions with only the existing 600 beds.  An additional 104 beds may make it even more difficult.

 

FISCAL IMPLICATIONS

 

The memorial will result in a minimal to minor cost increase to the CD in order to conduct the study and publish the report.

 

If the study demonstrates the need and advisability of expanding the facility and it is indeed expanded, the memorial will result in a need for capital outlay and operating funds.

 

ADMINISTRATIVE IMPLICATIONS

 

In the short term, the memorial results in a minor to moderate increase in the administrative burden upon a few CD employees who will be required to conduct the study and write the report.
