SUMMARY
Synopsis of
HAFC Amendment
The House Appropriations and Finance Committee
amendment increases the member contributions of the judicial and magistrate
retirement acts from 5 to 5 ½ percent.
This is contingent upon judges receiving a 6 percent salary increase, an
amount already incorporated into the General Appropriations Act of 2004. PERA should generate another $70.1 thousand
from this half percent increase in member contributions.
Synopsis of SJC Amendment
The Senate Judiciary Committee Amendment gives only
the presiding magistrate of a magistrate district where three or more divisions
operate as a single court an annual salary that is seventy-five
percent of the Chief Judge of a metropolitan court.

Significant Issues
Currently, under Section 34-1-9, the Chief
Justice of the Supreme Court and the Chief Judge of the Court of Appeals
receive a small ($2,000 per year for the Chief Justice, $1,900 for the Chief
Judge of the Court of Appeals) salary stipend for the additional duties
required of a chief justice or judge.
This bill will apply a similar stipend to all District
Court Chief Judges, the Chief Judge of the

FISCAL IMPLICATIONS
The appropriation of $32.4 contained is a recurring
expense to the General Fund. Any unexpended or unencumbered balance remaining
at the end of Fiscal Year 2005 shall revert to the General Fund.
