       Synopsis of SCORC Amendment

 

The Senate Corporations and Transportation Committee Amendment ensures that the room charge for all the units at all times in a lodging facility is less than the room charge established by local ordinance to allow for an exemption.  A lodging facility with a maximum daily room charge above the amount stated in the local ordinance would not be exempted from the fee.  

 

Synopsis of Original Bill

 

Senate Bill 189 amends the Convention Center Financing Act to make it easier for vendees to receive exemptions from the convention center fee.  The bill applies only to qualified municipalities that are located in Class A counties with a 2000 census population of more than 70,000 but less than 100,000.  Therefore, the city of Las Cruces is the only municipality impacted by the bill.  The bill changes the number of consecutive days a vendee must reside at a lodging facility to receive the exemption from thirty days to fifteen days.  It also allows vendees to be exempt from the fee if a local government ordinance exempts lodging facilities whose daily room charge is less than the amount stated in the local ordinance.  Lastly, the bill adds nonprofit organizations to the list of institutions exempted from the fee.

 

FISCAL IMPLICATIONS

 

The bill does not contain an appropriation.  The fiscal impact of expanding exemptions is indeterminate.
