The Senate Floor amendment to Senate Bill 100
strikes the emergency clause from the bill.
Synopsis of Original
Bill
Senate Bill 100
expands the role of the NMDOL secretary in unemployment insurance (UI) claims
adjudication to affirm, remand, reverse, or modify decisions made by a hearing
officer. Currently, the secretary only
has the power to affirm or remand a decision.
Additionally, the bill limits the people who can sit in on an
administrative or adjudicatory process.
This bill contains an emergency clause.
FISCAL IMPLICATIONS
There are no fiscal
implications associated with this bill.
OTHER SUBSTANTIVE ISSUES
Currently, in order to
reverse or modify an UI decision, the claim must be referred to the board of
review, which delays the processing of the claim by 30-45 days. Implementation of this bill will increase the
efficiency of the UI claims adjudication process. NMDOL estimates the processing time for
250-300 claims will be reduced by 30-45 days.
