SUMMARY

 

Synopsis of Bill

 

Senate Bill 59/SPACS extends the age through which adoption or permanent guardian assistance may be received when the child has significant medical or physical needs, and when, in the absence of intensive medical intervention and highly skilled care-taking, the child would be placed in an institution.

 

The bill states, in order to be eligible for extended subsidy payments, the child’s adoptive family or permanent guardian shall first apply for federal supplemental security income that may be available.  The extended subsidy payments shall be reduced by the amount of federal supplemental security income received by the child’s adoptive family or permanent guardian.

 

The bill provides extended subsidy payments shall not be paid retroactively.

 

            Significant Issues

 

The bill implements proposed changes offered by the Children, Youth and Families Department from the bill as originally introduced.

 

 

FISCAL IMPLICATIONS

 

The bill does not contain an appropriation. The increased duration of services will result in increased costs to the department.  The number of children qualifying will not be large, but the cost of their needed care will be significant.

 

ADMINISTRATIVE IMPLICATIONS

 

There will be a slight increase in the number of clients served through the Protective Services adoption / permanent guardian program.  The department should be capable of absorbing this slight increase into existing program resources.
