SUMMARY

 

Synopsis of Bill

 

Senate Bill 129 appropriates $472,100 from the general fund to the Administrative Office of the Courts (AOC) to replace federal funds for juvenile drug courts in the third, eleventh, twelfth and thirteenth judicial districts.

 

Significant Issues

 

The Judiciary is requesting funds to replace federal funds for the following Juvenile drug courts:

The AOC states that five of New Mexico’s established juvenile drug court programs are at risk of shutting down their operations in FY 05 because existing federal financial assistance is at the end of its funding cycle.  The federal Department of Justice monies for the drug court programs are intended to seed, not permanently support, drug court programs.  If the $472.1 be appropriated from the General Fund to the AOC, these five existing juvenile drug court programs will be able to continue their established programs to assist non-violent juvenile drug and alcohol offenders either presently participating in or entering these court-ordered programs in FY 05.

 

FISCAL IMPLICATIONS

 

The appropriation of $472.1 contained in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2005 shall revert to the general fund.

 

AOC reports that State funding for existing juvenile drug court programs will allow these programs to continue their operations at the same levels established with federal dollars, thus requiring administrative and fiscal personnel and resources to oversee and operate the drug court programs.
