Synopsis of HAGC Amendment

 

The House Agriculture & Water Resources Committee amendment requests, instead of obligating, the Governor, the State Engineer and various state and federal agencies dealing with New Mexico water to cooperate with the Acequia Commission.

 

Synopsis of Original Bill

 

House Joint Memorial 63 requests notification of the Acequia Commission when action affecting acequias or community ditches is considered.  The memorial notes the creation of the Acequia Commission and the requirement of the commission to provide advice and assistance to the Governor, Legislature, Office of the State Engineer and the Interstate Stream Commission in acequia and community ditch matters.  The Acequia Commission also serves as a facilitator for communication between acequia and community ditch associations and state and federal agencies, as well as review and comment on any plan or legislation affecting acequias or community ditches to the Governor, Legislature, Secretary of Agriculture and the Interstate Stream Commission.  The memorial also states the Governor, the legislature and various state and federal agencies dealing with New Mexico water are obligated to cooperate with the Acequia Commission in the discharge of these duties. 

Significant Issues

 

Significant issues relate to the importance of notifying the Acequia Commission of potential activities relating to acequias or community ditches so the commission will have the ability to provide advice and assistance to the bodies stated in NMSA 1978, Section 73-2-65. 

 

ADMINISTRATIVE IMPLICATIONS

 

Administrative impacts are minimal to the agencies cited in this memorial.
