SUMMARY
Synopsis of Bill
The bill amends the
phrase “great bodily injury” to “great bodily harm” to align with the statutory
definition. The bill also amends the definition for prior DWI convictions to
include those convictions within tribal boundaries. Finally, the bill increases
the basic sentence for conviction of great bodily harm by vehicle from two to
four years.
Significant Issues
As used in the Criminal Code (Section 30-1-1
NMSA 1978), "great bodily harm" means an injury to the person, which
creates a high probability of death, or which causes serious disfigurement, or
which results in permanent or protracted loss or impairment of the function of any
member or organ of the body.
