Synopsis of Bill

 

Senate Bill 535 amends sections of the Charter School Act.

 

Significant Issues

 

Senate Bill changes the dates for renewal of a charter school to the year in which the charter expires. This language and timeline are now consistent with the 60-day timeline for approval of an initial charter school.

 

Section 22-8B-12B amends the current language:  “The governing body of a charter school may submit a renewal application to the local school board by July 1 of the fiscal year in which the charter expires. The local school board shall rule on the renewal application by September 1 of the fiscal year in which the charter expires.”

The PED would need to continue to monitor the renewal process of charter schools.

Senate Bill 535 relates to SB403, HB404, SB474, SB521 and HB554.

 

OTHER SUBSTANTIVE ISSUES

 

According to PED, if Senate Bill does not pass, the language in the 1999 Charter School Act will remain in effect with the renewal date for a charter school being January 1 of the year prior to the year the charter expires. This requires charter schools to re-apply in the middle of their fourth year, 14 months before the local school board has to decide.
