Fiscal impact reports (FIRs) are prepared by the Legislative Finance Committee (LFC) for standing finance committees of the NM Legislature. The LFC does not assume responsibility for the accuracy of these reports if they are used for other purposes.

SUMMARY

 

            Synopsis of SFl Amendment #1

 

The Senate Floor Amendment #1 changes the language requiring the department to establish “bullying” guidelines and prevention policies (e.g., “shall”), to language simply allowing the department to establish such guidelines and prevention policies (e.g., “may”).  

 

Synopsis of Original Bill

 

The Senate Education Committee Substitute for Senate 185:

 

            -Defines bullying;

            -Removes the appropriation of $350.0 to PED;

            -Requires PED to establish guidelines for bullying prevention policies by August 2005;

-Requires local school boards to promulgate bullying prevention policies by August 2005; and

-Requires all public schools to implement bullying prevention programs by August 2007.

 

Significant Issues

 

The PED has trained 46 PBS coaches and 23 PBS trainers throughout the state. If this bill is passed, these individuals could be instrumental in establishing guidelines for bullying prevention policies and providing training and technical assistance to school districts to implement bullying prevention programs.

 

FISCAL IMPLICATIONS

 

The General Appropriations Act for FY 05 contains $350.0 for “bullying prevention”.

 

ADMINISTRATIVE IMPLICATIONS

 

The bill would require PED to develop guidelines and provide technical assistance to school districts to develop bullying prevention programs. PED indicates the department would be able to use existing staff to meet the requirements of this bill.
