Fiscal impact reports (FIRs) are prepared by the Legislative Finance Committee (LFC) for standing finance committees of the NM Legislature. The LFC does not assume responsibility for the accuracy of these reports if they are used for other purposes.

SUMMARY

 

      Synopsis of HJC Amendment

 

The House Judiciary Committee amendment deletes the requirement that the commission “in conjunction with the department of public safety” develop policies and procedures for conducting the background checks.  The policies and procedures as established by the legislation still require coordination with DPS.

 

Synopsis of Original Bill

 

House Bill 541 amends Section 60-1-5 NMSA 1978 to establish policies and procedures in coordination with the Department of Public Safety to use the data base known as NCIC (National Crime Information Center) to conduct criminal background checks as required by statute.

 

 

 

Significant Issues

 

Earlier this year the State Racing Commission was notified by the Federal Bureau of Investigations that it would no longer allow the commission access to the NCIC database if the statutes were not changed to establish specific policies and procedures with DPS for conducting background checks.

 

FISCAL IMPLICATIONS

 

The legislation requires that the applicant pay the costs associated with conducting a background check.  Therefore, the SRC reports, there will be no fiscal impact to the state.

 

ADMINISTRATIVE IMPLICATIONS

 

The SRC reports establishing the policies and procedures in statute will help cut down on current backlogs.
