SUMMARY

House Bill 64 exempts military retirement pay to New Mexico residents who served in the U.S. military or to their surviving spouses from state income taxation. The bill is applicable to tax years beginning on or after January 1, 2004.

FISCAL IMPLICATIONS

TRD’s fiscal impact analysis indicates that this bill would decrease state income tax revenues by $ 2.8 million in FY04 and $11.2 million in FY05 and subsequent years. The full year estimate assumes: there are 21 thousand military retirees in the state; average annual pension is $17 thousand; and the average applicable tax rate is 3.2 percent. The FY04 revenue loss assumes one quarter of the full year impact. TRD’s tables reporting the number of military retirees and average monthly pay for all states is attached.

ADMINISTRATIVE IMPLICATIONS

TRD reports moderate administrative implications that can be handled with existing resources.

OTHER SUBSTANTIVE ISSUES

TRD analysis raises the following issues:

· The measure encourages military retirees to move to New Mexico.

· Individuals with incomes and other circumstances similar to people receiving the proposed exemption are likely to view it as unfair, especially when they compete with the retirees for jobs, and when the retirees are individuals with relatively high incomes. According to information the “military com” website (http://usmilitary.about.com/) military retirement pay can be over $9,000 monthly for high-ranking officers retiring in 2004.
