AN ACT
RELATING TO DOMESTIC VIOLENCE; CREATING THE CRIME OF MALICIOUS EXPOSURE OF A DOMESTIC VIOLENCE SHELTER; PROVIDING PENALTIES FOR DISCLOSING THE LOCATION OF A DOMESTIC VIOLENCE SHELTER; ENACTING A SECTION OF THE NMSA 1978.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Crimes Against Household Members Act is enacted to read:
"[NEW MATERIAL] MALICIOUS EXPOSURE OF A DOMESTIC VIOLENCE SHELTER.--
A. Malicious exposure of a domestic violence shelter consists of the disclosure of the location of a domestic violence shelter by a person with the intent of:
(1) encouraging or enabling physical harm of the domestic violence shelter or its occupants; or
(2) intimidating, harassing or frightening one or more occupants or the staff of a domestic violence shelter.
B. Whoever commits malicious exposure of a domestic violence shelter is guilty of a misdemeanor and the offender shall be sentenced to a jail term of not less than seventy-two consecutive hours that shall not be suspended, deferred or taken under advisement."
