AN ACT
RELATING TO ELECTIONS; ALLOWING OBSERVERS TO BE PRESENT WHEN THE COUNTY CLERK OR COUNTY CANVASSING BOARD IS VERIFYING OR COUNTING PROVISIONAL PAPER BALLOTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Election Code is enacted to read:
"[NEW MATERIAL] PROVISIONAL PAPER BALLOTS--VERIFYING AND COUNTING--WHO MAY BE PRESENT.--Only the county clerk, members of the county canvassing board, candidates or their representatives, representatives of the media and lawfully appointed challengers and watchers may be present while provisional paper ballots are being verified or counted and tallied. Only the county clerk or members of the county canvassing board shall handle ballots, signature rosters or tally sheets or take part in the verification, counting or tallying."
