AN ACT
RELATING TO PUBLIC MONEY; ALLOWING STATE AGENCIES TO AUTHORIZE CREDIT CARD PROCESSORS TO CHARGE A CONVENIENCE FEE TO THE STATE FOR PROCESSING CREDIT OR DEBIT CARD PAYMENTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 6-10-1.2 NMSA 1978 (being Laws 1999, Chapter 176, Section 1) is amended to read:
"6-10-1.2. PAYMENT METHODS AUTHORIZED.--A state agency may accept payment by credit or debit card or electronic means of any amount due the state under any law or program administered by the agency. The state agency may authorize the credit card processor to charge a convenience fee payable to the credit card processor for the cost of processing the credit or debit card transaction. The state board of finance shall adopt rules on the terms and conditions of accepting payments by credit or debit card or electronic transfer."
