FOR THE CORRECTIONS OVERSIGHT AND JUSTICE COMMITTEE

AN ACT

MAKING AN APPROPRIATION TO PROVIDE SALARY INCREASES FOR JUSTICES, JUDGES, CHILD SUPPORT HEARING OFFICERS AND SPECIAL COMMISSIONERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--

          A. One million nine hundred fifty-seven thousand six hundred sixty dollars ($1,957,660) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2005 to provide justices of the supreme court with a salary increase to one hundred ten thousand dollars ($110,000). Salary increases, pursuant to the provisions of Section 34-1-9 NMSA 1978, shall also be provided to:

                (1) the chief justice of the supreme court;

                (2) the chief judge of the court of appeals;

                (3) judges of the court of appeals, district courts, metropolitan courts and magistrate courts;

                (4) child support hearing officers; and

                (5) special commissioners.

          B. The salary increases shall be effective the first full pay period after July 1, 2004.

          C. Any unexpended or unencumbered balance remaining at the end of fiscal year 2005 shall revert to the general fund.
