"Section 5. FUND CREATED.--
A. The "animal care and facility fund" is created in the state treasury. All money collected by the board pursuant to the Animal Sheltering Services Act shall be transmitted to the state treasurer, who shall credit them to the fund. The fund shall not revert at the end of any fiscal year. All income from investment of the fund shall remain in the fund. Money appropriated to the fund or accruing to it through fees; cooperative research agreements; income; gifts; grants; donations; bequests; sales of promotional items, handbooks or educational materials; or any other source shall not be transferred to another fund or encumbered or expended in any manner except for expenditures pursuant to the Animal Sheltering Services Act. The fund shall be administered by the regulation and licensing department and money in the fund is appropriated to the department to carry out the purposes of that act. Disbursements from the fund shall be made only upon warrant drawn by the secretary of finance and administration pursuant to vouchers signed by the superintendent of regulation and licensing or the superintendent's designee.
B. Money in the fund shall be used to help animal shelters defray the cost of implementing the board's initiatives conducted pursuant to the Animal Sheltering Services Act.".
