AN ACT
MAKING APPROPRIATIONS TO PROVIDE LEGAL REPRESENTATION FOR DEFENDANTS IN CAPITAL FELONY CASES THAT AROSE FROM THE RIOT AT THE GUADALUPE COUNTY CORRECTIONAL FACILITY; DECLARING AN EMERGENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATION.--Six hundred ninety-five thousand dollars ($695,000) is appropriated from the general fund to the public defender department for expenditure in fiscal year 2004 and subsequent fiscal years to provide legal representation for defendants in capital felony cases that arose from the riot at the Guadalupe county correctional facility. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
Section 2. APPROPRIATION.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the public defender department for expenditure in fiscal year 2005 and subsequent fiscal years to provide legal representation for defendants in capital felony cases that arose from the riot at the Guadalupe county correctional facility. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
