AN ACT
RELATING TO BOATING; CLARIFYING PENALTIES FOR A VIOLATION OF THE BOAT ACT; AMENDING AND REPEALING SECTIONS OF THE NMSA 1978.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 66-12-23 NMSA 1978 (being Laws 1963, Chapter 45, Section 9, as amended) is amended to read:
"66-12-23. PENALTIES.--[Any] A person who violates [any] a provision of the Boat Act or [any] a regulation of the state [park and recreation] parks division of the energy, minerals and natural resources department promulgated pursuant to that act is guilty of a [misdemeanor and shall be punished by a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500) or by imprisonment for not more than thirty days or both] petty misdemeanor and shall be sentenced pursuant to the provisions of Section 31-19-1 NMSA 1978."
Section 2. REPEAL.--Section 66-12-24 NMSA 1978 (being Laws 2003, Chapter 410, Section 8) is repealed.
Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2004.
