AN ACT
MAKING AN APPROPRIATION TO THE DEPARTMENT OF HEALTH TO CONTINUE THE STATEWIDE SMART MOVES YOUTH SMOKING CESSATION PROGRAM.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the tobacco settlement program fund to the department of health for expenditure in fiscal year 2005 to continue the statewide smart moves youth smoking cessation program. Any unexpended or unencumbered balance remaining at the end of fiscal year 2005 shall revert to the tobacco settlement program fund; provided that if another bill of the second session of the forty-sixth legislature is enacted into law that either abolishes the tobacco settlement program fund or transfers all balances from that fund, then the appropriation in this section shall be from the general fund and any unexpended or unencumbered balance shall revert to the general fund.
