    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 455

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 2, line 5, after "attorney" insert ", division 2,".

     2. On page 2, lines 11 and 12, strike "salaries and benefits and furniture, supplies and equipment for additional staff" and insert in lieu thereof "contractual services".

     3. On page 2, lines 20 through 22, strike "salaries and benefits and furniture, supplies and equipment for additional staff" and insert in lieu thereof "contractual services".

     4. On page 3, line 20, after "balance" insert "of an appropriation made to a district attorney".

     5. On page 3, between lines 22 and 23, insert the following new subsection:

          "C. Any unexpended or unencumbered balance of an appropriation made to the public defender department remaining at the end of fiscal year 2005 shall not revert to the general fund.",

and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
