AN ACT

MAKING AN APPROPRIATION FOR COST-OF-LIVING INCREASES FOR PUBLIC EMPLOYEES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATIONS--GENERAL FUND.--

          A. Eighty-six million five hundred two thousand six hundred dollars ($86,502,600) is appropriated from the general fund to the department of finance and administration for distribution to the appropriate state agency for expenditure in fiscal year 2005 to provide three-percent cost-of-living salary increases to public employees as follows:

                (1) forty-seven million four hundred fifty-eight thousand eight hundred dollars ($47,458,800) for public school employees, including transportation employees;

                (2) nineteen million two hundred ninety-three thousand nine hundred dollars ($19,293,900) for faculty and staff at public post-secondary educational institutions;

                (3) the following amounts for state employees in state agencies in the executive branch of state government whose funds are derived substantially from the general fund:

                     (a) two million four hundred nine thousand nine hundred dollars ($2,409,900) for exempt employees, including attorney general employees, workers' compensation judges and teachers in the children, youth and families department, department of health and corrections department, and for commissioned officers of the New Mexico state police division of the department of public safety; and

                     (b) thirteen million six hundred fifty thousand nine hundred dollars ($13,650,900) for classified employees;

                (4) three hundred nine thousand dollars ($309,000) for legislative permanent employees;

                (5) the following amounts for judicial employees:

                     (a) four hundred ninety-eight thousand six hundred dollars ($498,600) for justices, judges, child support hearing officers and special commissioners; and

                     (b) one million seven hundred sixty-two thousand eight hundred dollars ($1,762,800) for judicial permanent employees; and

                (6) the following amounts for district attorney employees:

                     (a) forty-five thousand nine hundred dollars ($45,900) for elected district attorneys; and

                     (b) one million seventy-two thousand eight hundred dollars ($1,072,800) for district attorney permanent employees.

          B. For those state employees whose salaries are referenced in or received as a result of non-general fund appropriations in the General Appropriation Act of 2004, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those provided for in Subsection A of this section, and such amounts are appropriated for expenditure in fiscal year 2005.

          C. Salary increases provided for in Subsections A and B of this section shall be effective the first pay period after July 1, 2004.

          D. Any unexpended or unencumbered balance of the appropriations in this act remaining at the end of fiscal year 2005 shall revert to the general fund or other appropriate fund.
