AN ACT

RELATING TO HEALTH; DIRECTING THE HUMAN SERVICES DEPARTMENT TO MANDATE A 340B DRUG PRICING PROGRAM; ENACTING A NEW SECTION OF THE PUBLIC ASSISTANCE ACT; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Public Assistance Act, Section 27-2-12.14 NMSA 1978, is enacted to read:

     "27-2-12.14. [NEW MATERIAL] 340B DRUG PRICING PROGRAM.--The department shall carry out program changes to ensure that all eligible entities identified by the department in Paragraph (3) of Subsection A of Section 27-2-12.13 NMSA 1978 shall participate in the federal drug pricing program under Section 340B of the federal Public Health Service Act."

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
