PROPOSING THE TRADE OF STATE-OWNED LAND AT SANTA TERESA IN DONA ANA COUNTY TO THE FEDERAL GOVERNMENT IN EXCHANGE FOR LAND AT THE WEST CAPITOL COMPLEX IN SANTA FE COUNTY.
WHEREAS, Section 13-6-3 NMSA 1978 requires ratification
and approval of any sale, trade or lease of state property over one hundred thousand dollars ($100,000) in value; and
WHEREAS, the state owns approximately ten acres of land at the Santa Teresa border area in Dona Ana county, which includes the temporary port of entry facility and adjacent land; and
WHEREAS, the United States government owns approximately nine and two-tenths acres of land adjacent to state-owned land at the west capitol complex in Santa Fe county, part of which is occupied by the United States forest service; and
WHEREAS, the state is desirous of developing the west capitol complex, pursuant to a master plan adopted by the capitol buildings planning commission, and this master plan includes the federal land; and
WHEREAS, the federal government is interested in acquiring land at the Santa Teresa border area in Dona Ana county; and
WHEREAS, the state-owned property in Dona Ana county totals approximately ten acres and includes a five and ninety-five hundredths acre parcel that was used as a temporary border crossing during the time the permanent federal facility was being built, as well as the state land located between the temporary facility and the permanent Santa Teresa border crossing station. The ten-acre parcel is adjacent to the Santa Teresa international beltway within section 18, township 29 south, range 3 east, New Mexico principal meridian, Dona Ana county; and
WHEREAS, the property owned by the federal government at the west capitol complex in Santa Fe county totals approximately eleven acres and consists of United States forest land plus the adjacent federal motor pool property. The eleven-acre parcel is bounded on the north by a state-owned parcel where the state library and archives center is located, on the east by the college of Santa Fe, on the south by the city of Santa Fe and on the southwest by land owned by the Santa Fe public schools. It is located in section 34, township 17 north, range 9 east, Santa Fe county;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the trade of state-owned land in Dona Ana county to the federal government in exchange for land at the west capitol complex in Santa Fe county be ratified and approved, subject to approval by the chair of the New Mexico border authority, as an equal-value exchange pursuant to Section 13-6-3 NMSA 1978; and
BE IT FURTHER RESOLVED that the state of New Mexico pay for a survey of the land in Santa Fe county and the United States pay for a survey of the land in Dona Ana county; and
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the general services department, the New Mexico border authority and the United States general services administration.
