REQUESTING THE STATE TO CONSULT WITH NATIVE AMERICAN TRIBES AS PART OF THE PERMITTING PROCESS FOR MINING OPERATIONS THAT IMPACT TRIBES.
WHEREAS, Native American health, welfare and way of life and the Native American economy are affected by mining operations near indigenous communities; and
WHEREAS, the New Mexico Mining Act and the Water Quality Act, when properly enforced, assist in protecting the health, welfare, livelihoods and way of life of Native Americans; and
WHEREAS, Native American lands are often significant for cultural and religious purposes; and
WHEREAS, the legislature of the state of New Mexico wishes to ensure that Native American rights, traditions and customs are respected;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the secretary of energy, minerals and natural resources be requested to consult with the leaders of indigenous communities and Native American tribes in the permitting process for mining operations when those operations may impact indigenous communities and tribes; and
BE IT FURTHER RESOLVED that the secretary of energy, minerals and natural resources and the secretary of environment be requested to continue to properly enforce the provisions of the New Mexico Mining Act and the Water Quality Act; and
BE IT FURTHER RESOLVED that copies of this memorial be transmitted to secretary of energy, minerals and natural resources and the secretary of environment.
