SUMMARY

 

     Synopsis of Bill

 

SJM 102 requests the New Mexico Congressional delegation to introduce legislation to amend federal law so that states may allow a private business to operate gas station services at a safety rest area if the private business agrees to maintain the safety rest area.

 

Copies of the memorial are to be transmitted to the members of the Congressional delegation and the Secretary of State Highway and Transportation Department.

      

     Significant Issues

 

United States Code, Title 23, Section 111 requires that the State agree to no commercial establishments on right of way when federal funds are utilized.  

 

RELATIONSHIP

 

SJM 102 relates to SB611 which prohibits the State Highway and Transportation Department from using state or federal dollars to supervise, maintain or operate a safety rest area and gives the Department the authority to contract with private food providers to supervise, maintain or operate the safety rest areas and/or to operate a private restaurant at the safety rest area.
