SUMMARY
Synopsis
of Bill
Senate Bill 825 amends Section 3-12-3 NMSA 1979
to clarify that in municipalities with a mayor-council form of government, the
mayor shall, as provided in Section 3-11-3 NMSA 1978, vote to break a tie vote
when the council is voting on a measure unless he has a conflict of interest.

The mayor of a municipality is the presiding officer of the governing body. In all municipalities the mayor shall vote only when there is a tie vote.
