SUMMARY
Synopsis
of Bill
Senate Bill 504
creates a non-reverting Judges Pro Tempore Fund in the State Treasury and appropriates
an unspecified amount of unreverted general fund money to the Administrative
Office of the Courts (
There is an emergency
clause in SB 504 so that the provisions of this legislation will take effect
immediately.

FISCAL
IMPLICATIONS
The appropriation contained
in this bill is a recurring expense to the general fund. Any unexpended or unencumbered balance
remaining at the end of each fiscal year shall not revert to the general fund.
Continuing Appropriations
This bill creates a
new fund and provides for continuing appropriations. The LFC objects to including continuing
appropriation language in the statutory provisions for newly-created
funds. Earmarking reduces the ability of
the Legislature to establish spending priorities.
ADMINISTRATIVE IMPLICATIONS

the judiciary may need to address who should have a Judges Pro Tempore Fund,
how much funding is needed, how the funding is requested and who administers
it.

clarified to delineate which money, from which fiscal year and how much money
is to be appropriated.
