FISCAL IMPLICATIONS
The appropriation of
$50.0 contained in this bill is a non-recurring expense to the general fund.
Any unexpended or unencumbered balance remaining at the end of fiscal year 2004
shall revert to the general fund.
ADMINISTRATIVE IMPLICATIONS
OCA indicates there
would be modest staff time required for the RFP process, contract review,
processing and implementation, planning, set-up, delivery and evaluation of
program services.
DUPLICATION
This bill duplicates a
portion of House Bill 234, which appropriates $50.0 for the same purpose;
however, House Bill 234 does not specifically mention that the education
services would be provided by the New Mexico Symphony Orchestra as specified in
Senate Bill 184. (See substantive issues below.)
OTHER SUBSTANTIVE ISSUES
Although the New
Mexico Symphony Orchestra is expected to provide the services proposed in this
bill, the State Procurement Code and anti-donation laws would require OCA to
follow the RFP process to contract for the education services proposed. The New Mexico Symphony Orchestra, however,
could submit a proposal along with any other interested vendors for these services.
