Synopsis
of HJC Amendment
The House Judiciary Committee amendments make a
technical change on page 3, line 10 to read “All petitions filed under
Subsections B and C” rather than “A petition.”
Synopsis
of Original Bill
House Bill 436 clarifies
a provision in the Election Code to require a declaration of candidacy for
minor party candidates who are convention-designated nominees. Along with the declaration, minor party
candidates must submit a petition containing the signatures and addresses of no
less than one percent of the total number of votes cast in the preceding
general election for governor or president of the

There is no
appropriation or significant fiscal impact associated with this bill.
OTHER SUBSTANTIVE ISSUES
The Secretary of State
notes it is not possible to determine if a candidate is qualified for an office
without a declaration of candidacy.
