SUMMARY
Synopsis
of Bill
House
Bill 235 amends the Water and Sanitation District Act [NMSA 1978 Section
73-21-4] to allow Water and Sanitation Districts to be formed in any county
within New Mexico. Section 73-21-4
currently authorizes Water and Sanitation Districts to be formed only in class
A or class B counties with populations greater than 90,000, which as of April
30, 2002 are Bernalillo, Dona Ana, San Juan, and Santa Fe counties.
Significant
Issues
The Office of the State Engineer reports the following concern: enactment of the bill may lead to an increase in requests, and thus application, to the State Engineer for determinations of whether the proposed district has adequate water rights pursuant to NMSA 1978 section 73-21-9 from district courts acting on petitions to form Water and Sanitation Districts.
FISCAL IMPLICATIONS
House Bill 235 does
not contain an appropriation and no fiscal impact has been reported by those
agencies who have analyzed this bill.
