SUMMARY

 

     Synopsis of Bill

 

House Bill 174 amends Section 66-5-15 NMSA 1978 directing that any information contained in the magnetic strip on the back of a driver’s license or any other electronically accessible information on a driver’s license must be limited to the information available on the face of the license.

 

     Significant Issues

 

  1. MVD is already in compliance with the provisions proposed in this bill.  The only information contained in the magnetic strip is the following:

 

Driver’s full name

                        Address

                        City and State 

                        Driver’s License Number

                        Expiration Date

                        Date of Birth

 

  1. Although a social security number is currently required when applying for a driver’s license, the social security number is not part of the information included on the magnetic strip. 

 

  1. In the future, the federal government may require additional information be included on driver’s licenses or that the information be electronically accessible to the federal government for security reasons.

                       

FISCAL IMPLICATIONS

 

There are no fiscal implications associated with this bill.

 

TECHNICAL ISSUES

 

HB 174 solely addresses driver’s licenses.  The Motor Vehicle Division also issues identification cards with similar technology.  Should ID cards be included in this legislation too?
