The Senate Public Affairs Committee Amendment to Senate Bill 101 adds and includes the real estate appraisers board to the intent of the entire bill.
Synopsis
of Bill
Senate Bills 101 amends several professional and
occupational licensing acts to specify that the boards are administratively
attached to the Regulation and Licensing Department (RLD). The bill further amends these acts to delete
any reference to these boards independent authority to hire or fire personnel.
Significant
Issues
Twenty-eight (28)
professional and occupational licensing boards reside within the Boards and
Commissions Division of RLD. Some of
these boards existed as independent state agencies prior to the creation of RLD
by the legislature in 1983. Others have
been established since the creation of RLD.
Although administrative control of these licensing boards was
transferred to RLD through a series of Executive Orders issued subsequent to
the creation of RLD, their administrative attachment to RLD has never been
codified. Similarly, many of these board
statutes still reflect authority over personnel matters dating from their
origins as independent state agencies, and do not reflect the current reality
that the RLD Superintendent is the hiring authority for all personnel attached
to the department.
Boards included in
SB101 are Optometry, Chiropractic, Dental Health Care, Dental Hygienists
Committee, Podiatry, Psychologist Examiners, Osteopathic Medical Examiners, Board
of Pharmacy, Occupational Therapy, Physical Therapy, Respiratory Care, Nursing
Home Administrators, Acupuncture and Oriental Medicine, Speech Language Pathology,
Audiology and Hearing Aid Dispensing Practices, Landscape Architects, Interior
Design, Public Accountancy, Real Estate Commission, Real Estate Appraisers, and
Social Work Practice.
All of the other RLD
board statutes either already include language administratively attaching them
to RLD, or do not include language giving the boards authority over personnel
matters.
ADMINISTRATIVE IMPLICATIONS
Senate Bill 101 allows
for consistency and clarity in administration and operation of the agency
relating to the boards and commissions.
While reasonable autonomy of the boards is necessary, this legislation
supports the intent of the creation of RLD.
