SUMMARY

 

     Synopsis of Bill

 

House Bill 78 amends Section 75-3-2 NMSA 1978 assign to responsibilities for weather modification to the Interstate Stream Commission (ISC) from the Weather Control and Cloud Modification Commission.  All fees collected for weather modification will be used by the ISC for carrying out the purposes of this act.  Provisions of existing statute pertaining to the Weather Control and Cloud Modification Commission are stricken.

 

     Significant Issues

 

The bill transfers authority to administer weather control and cloud modification from the Weather Control and Cloud Modification Commission to the ISC; however, it does not transfer any funding or FTE.  OSE estimates that 1 FTE and funding at $100.0 will be required.  The bill also does not transfer any existing fund balances that may be available from the Weather Control and Cloud Modification Commission.

 

ADMINISTRATIVE IMPLICATIONS

 

Rules and regulations will have to be promulgated by the ISC.  Existing licenses issued by the Weather Control and Cloud Modification Commission will have to be reissued by the ISC.
