AN ACT

RELATING TO HIGHWAYS; AUTHORIZING THE STATE HIGHWAY AND TRANSPORTATION DEPARTMENT TO GRANT EASEMENTS TO THE NAVAJO NATION FOR CERTAIN USES; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. GRANT OF EASEMENT TO THE NAVAJO NATION.--When requested by the Navajo Nation, the secretary of highway and transportation shall grant an easement along a state highway or other road under the jurisdiction of the state highway and transportation department to the Navajo Nation for the purpose of extending water or utility lines or for other beneficial uses that do not conflict with the use of the land for the highway.

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
