Your EDUCATION COMMITTEE, to whom has been referred



SENATE BILL 691



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 1, line 20, after "of" strike the remainder of the line, strike line 21 in its entirety and insert in lieu thereof:



"planning and budgeting functions for the statewide adult basic education program and authority to adopt and promulgate rules for all such adult educational programs. The commission will establish a uniform protocol for identifying, communicating with and providing direct and equitable access to funding for eligible agencies, which include:



A. local educational agencies;



B. community-based organizations;



C. volunteer literacy organizations;



D. post-secondary institutions;



E. public or private nonprofit agencies;



F. public libraries;



G. public housing authorities; and



H. a consortium of agencies, organizations, institutions, libraries or authorities as described in Section 203 Public Law 105.".





2. On page 9, between lines 9 and 10, insert the following new Section 5 to read:



"Section 5. Section 22-13-11 NMSA 1978 (being Laws 1967, Chapter 16, Section 185) is amended to read:



"22-13-11. ADULT EDUCATION CLASSES.--[A.] Pursuant to the standards and regulations of the state board, a local school board may establish an adult education class within the school district, provided that the minimum enrollment for any adult education class shall be ten persons. The local school board has authority to employ a certified school instructor to teach in any adult education class established.



[B. The state board shall establish standards and promulgate regulations for the establishment and operation of an adult education class.]"".



3. Renumber the succeeding sections accordingly.



4. On page 10, line 15, after "supplies" strike the remainder of the line, strike line 16 up to the period and insert in lieu thereof "applied to the administration of the state's adult basic education programs by the state department of public education shall be transferred to the commission on higher education".
