AN ACT

RELATING TO THE STATE TRANSPORTATION COMMISSION; AMENDING THE PROVISIONS FOR REMOVAL OF COMMISSIONERS; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 67-3-5 NMSA 1978 (being Laws 1967, Chapter 266, Section 4, as amended) is amended to read:

"67-3-5. REMOVAL OF COMMISSIONERS.--[GROUNDS.--Highway commissioners shall not be removed except for incompetence, neglect of duty or malfeasance in office. No removal shall be made] The state transportation commission, appointed by the governor and confirmed by the senate, shall serve at the pleasure of the governor. Transportation commissioners, appointed and confirmed by the senate pursuant to Subsection B of Section 67-4-5 NMSA 1978, shall not be removed without prior approval of the senate."

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
