RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE OF UNLAWFUL CARRYING OF A DEADLY WEAPON INTO AN AIRPORT; PROVIDING PENALTIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 30, Article 7 NMSA 1978 is enacted to read:
"[NEW MATERIAL] UNLAWFUL CARRYING OF A DEADLY WEAPON INTO AN AIRPORT.--
A. Unlawful carrying of a deadly weapon into an airport consists of a person carrying a deadly weapon into an area of an airport terminal where access is controlled by the inspection of persons and property.
B. The provisions of Subsection A of this section do not apply to:
(1) a law enforcement officer in the lawful discharge of his duties; or
(2) a privately employed security officer in the lawful discharge of his duties.
C. A person who commits unlawful carrying of a deadly weapon into an airport is guilty of a fourth degree felony."
Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
