AN ACT

RELATING TO GUARDIANSHIP; CREATING THE OFFICE OF GUARDIANSHIP SERVICES AS AN ADJUNCT AGENCY; PROVIDING FOR TRANSFERS OF FUNCTIONS, PROPERTY, CONTRACTUAL OBLIGATIONS AND STATUTORY REFERENCES FROM THE OFFICE OF THE ATTORNEY GENERAL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. OFFICE OF GUARDIANSHIP SERVICES.--

A. The "office of guardianship services" is created as an adjunct agency in the executive branch. The office shall negotiate and administer contracts with community service providers to provide probate guardianship to income-eligible adults in New Mexico.

B. The governor shall appoint a "director" for the office. Within available funds, the director may employ such clerical and professional assistants as necessary.

Section 2. TEMPORARY PROVISION--TRANSFERS.--

A. On the effective date of this act, all functions, appropriations, money, records, files, furniture, equipment, supplies and other property of the office of guardianship services in the office of the attorney general are transferred to the office of guardianship services.

B. On the effective date of this act, all contractual obligations of the office of guardianship services in the office of the attorney general are transferred to the office of guardianship services.

C. On the effective date of this act, all references in the law to the office of guardianship services in the office of the attorney general are transferred to the office of guardianship services.

Section 3. REPEAL.--Section 8-5-16 NMSA 1978 (being Laws 1995, Chapter 140, Section 1) is repealed.
