AN ACT

RELATING TO ECONOMIC DEVELOPMENT; CREATING THE FILM ADVISORY BOARD; CREATING AN EXECUTIVE BOARD; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Economic Development Department Act is enacted to read:

"[NEW MATERIAL] FILM ADVISORY BOARD--CREATED--MEMBERSHIP--EXECUTIVE BOARD.--

A. The "film advisory board" is created to advise the department and the governor on ways to promote film production in New Mexico, assist in the design and implementation of the department's strategic plan for building a media infrastructure in the state, assist in designing a workforce training program for film production and make recommendations for incentives and funding for these efforts.

B. The film advisory board shall be composed of no more than thirty members appointed by the governor for four-year staggered terms; provided that the initial appointments shall be made so that one-half of the members shall be appointed for two-year terms and one-half of the members shall be appointed for four-year terms. Terms shall expire on January 1.

C. From the membership of the film advisory board, the governor shall appoint a seven-member "executive board". At least five members of the executive board shall have experience in some aspect of film production. The executive board shall:

(1) with the approval of the secretary, create subcommittees of the film advisory board and name the chairmen of those subcommittees;

(2) coordinate activities of the subcommittees and the film advisory board; and

(3) develop recommendations pertaining to the charges of the film advisory board for the consideration of the film advisory board.

D. The governor shall name the chairman of the film advisory board, who shall serve as the chairman of the executive board. The film advisory board may elect such other officers as it deems necessary. The film advisory board shall meet at the call of the chairman, at least quarterly. Members

of the film advisory board may receive per diem and mileage as provided in the Per Diem and Mileage Act, but shall receive no other compensation, perquisite or allowance.

E. Staff for the film advisory board shall be provided by the department.

F. The film advisory board shall report to the department, the governor and the legislature by December 1 of each year on its activities and recommendations."

Section 2. APPROPRIATION.--One hundred thousand dollars ($100,000) is appropriated from the general fund to the economic development department for expenditure in fiscal years 2003 and 2004 to fund the film advisory board. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.

Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
