RELATING TO CRIMINAL LAW; PROHIBITING INDIVIDUALS CONVICTED OF A SEXUALLY VIOLENT CRIME IN ANOTHER STATE FROM MOVING TO AND RESIDING IN NEW MEXICO.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. INDIVIDUALS CONVICTED OF A SEXUALLY VIOLENT CRIME IN ANOTHER STATE--PROHIBITED FROM MOVING TO NEW

MEXICO.--

A. Individuals who have been convicted of a sexually violent crime in another state are prohibited from moving to and residing in this state.

B. As used in this section, "sexually violent crime" means a criminal offense in another state that is equivalent to:

(1) criminal sexual penetration in the first degree, as provided in Subsection C of Section 30-9-11 NMSA 1978; or

(2) criminal sexual penetration in the second degree, as provided in Subsection D of Section 30-9-11 NMSA 1978.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
