AN ACT

RELATING TO THE BOARD OF PHARMACY; PROVIDING THAT THE BOARD OF PHARMACY IS NOT ADMINISTRATIVELY ATTACHED TO THE REGULATION AND LICENSING DEPARTMENT; ENACTING A NEW SECTION OF THE PHARMACY ACT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Pharmacy Act is enacted to read:

"[NEW MATERIAL] BOARD IS NOT ADMINISTRATIVELY ATTACHED TO THE REGULATION AND LICENSING DEPARTMENT.--The board is not administratively attached to the regulation and licensing department. Executive Order 86-10, issued pursuant to legislative authority provided in Laws 1983, Chapter 297, Section 30, is void as it pertains to control and supervision of the board by the regulation and licensing department."

Section 2. TEMPORARY PROVISION--TRANSFER OF MONEY, RECORDS, SUPPLIES, EQUIPMENT, FURNITURE AND OTHER PROPERTY.--On the effective date of this act, all money, records, supplies, equipment, furniture and other property that belongs to the board of pharmacy and that is held by the regulation and licensing department shall be transferred to the board of pharmacy.

Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
